These Terms & Conditions (“Terms”) govern your access to and use of Houwlly.com (“Houwlly,” “we,” “our,” or “the Platform”). By registering for an account or using the services provided on the Platform, you agree to be bound by these Terms and by our Privacy Policy.

These Terms apply to all users of the Platform, including Service Providers (those who offer services) and Service Seekers (those who purchase services), engaging through gig service-based models including hourly, fixed-price, and milestone-based service types.


1. Definitions

  • Platform – Refers to Houwlly.com and any related features, subdomains, or services.

  • Service Provider – A registered user offering services through the Platform.

  • Service Seeker – A registered user who purchases services on the Platform.

  • Gig Service – A structured service offered on the Platform, defined by deliverables, scope, and price.

  • Order – A confirmed agreement between a Service Provider and a Service Seeker to perform a service.


2. Eligibility

To use the Platform, users must:

  • Be at least 18 years old or the legal age in their jurisdiction;

  • Possess the authority to enter into legally binding agreements;

  • Provide accurate and complete registration information.


3. Account Registration

  • All users must create an account to access Platform features.

  • Users are responsible for maintaining the security of their login credentials.

  • The Platform may suspend or terminate accounts for violations of these Terms or misuse of the Platform.

  • Multiple accounts or impersonation of another individual or entity is prohibited.


4. Types of Services Offered

The Platform supports various service engagement models, including:

a. Fixed-Price Services

  • Services are provided for a single, upfront payment.

  • Payment is released upon delivery and approval of the agreed work.

b. Hourly Services

  • Service Providers track time spent on a project.

  • Service Seekers are billed according to the hourly rate agreed in advance.

c. Milestone-Based or Custom Services

  • Work is broken into phases or deliverables.

  • Payment is released upon completion and approval of each milestone.


5. Use of the Platform

Service Providers:

  • May create listings for services under one or more service types.

  • Must fulfill services as described in their listings.

  • Must deliver services in a timely and professional manner.

  • Are responsible for compliance with all applicable laws and regulations.

Service Seekers:

  • May browse, select, and purchase services listed by Service Providers.

  • Must provide necessary details and requirements to initiate the service.

  • Are responsible for reviewing and accepting the completed work within the applicable timeframe.


6. Payments and Fees

  • Service Seeker Fee: A 3% service fee is added to the total purchase price at checkout.

  • Service Provider Commission: A 7% commission is deducted from the earnings of each completed order.

  • All payments are processed through third-party providers such as Stripe Express.

  • The Platform does not store credit card or payment account details.


7. Order Process

  • Orders are initiated by the Service Seeker purchasing a service.

  • The Service Seeker submits all necessary requirements to begin the work.

  • The Service Provider delivers the service within the agreed timeframe.

  • The Service Seeker must approve or request changes within the specified review window.

  • Orders may be marked complete automatically if the Service Seeker does not respond within the review period.


8. Refunds and Disputes

  • Refunds are only granted if the service was not delivered as agreed or was materially incomplete.

  • Requests for refunds must be submitted within 3 calendar days of delivery.

  • The Platform will review all disputes and make a final decision, which is binding.

  • No refunds will be issued once the order has been accepted or auto-completed.


9. Payouts to Service Providers

  • Payouts are released 5 business days after an order is marked complete.

  • Supported payout methods include Stripe Express, Wise, or others approved by the Platform.

  • The Service Provider must have a valid payout method configured.

  • Payouts may be delayed due to disputes, verification processes, or technical issues.


10. Prohibited Conduct

Users must not:

  • Violate applicable laws or third-party rights

  • Post false, deceptive, or misleading content

  • Circumvent Platform fees or engage in off-platform transactions

  • Use bots, automation tools, or malicious software

  • Post spam, hate speech, or abusive content

Violations may result in account suspension or permanent ban without notice.


11. Intellectual Property

  • Upon full payment, ownership of completed deliverables transfers to the Service Seeker, unless otherwise stated.

  • Users retain rights to content they upload to the Platform but grant the Platform a non-exclusive license to display and host such content.

  • The Platform complies with valid copyright takedown requests in accordance with applicable laws.


12. Termination

We reserve the right to suspend or terminate user accounts without prior notice if:

  • These Terms are violated

  • Fraudulent or harmful activity is detected

  • Legal obligations require such action

Users may request account deletion by contacting support@houwlly.com.


13. Limitation of Liability

  • The Platform is provided “as is” and “as available.”

  • We do not guarantee continuous access, error-free functionality, or specific outcomes.

  • We are not liable for any indirect, incidental, or consequential damages.

  • Our maximum liability is limited to the total fees paid to us in the six months preceding the claim.


14. Indemnification

You agree to indemnify and hold harmless Houwlly.com and its affiliates from any claims, damages, or expenses arising out of:

  • Your use of the Platform

  • Your breach of these Terms

  • Your violation of any law or third-party rights


15. Modifications to Terms

We may revise these Terms at any time. Changes will be posted on this page with an updated effective date.
Continued use of the Platform constitutes your acceptance of the updated Terms.


16. Governing Law

These Terms are governed without regard to any specific jurisdiction or location.
Any legal matters shall be resolved under applicable laws as determined by the Platform.


17. Service Provider Listing Plans & Subscription Fees

Service Providers may choose from the following listing plans to post their services:

a. Basic Plan – Free

  • Up to 10 listings

  • Visible for 60 days

  • No cost

b. Extended Plan – $9.99 (One-Time Fee)

  • Up to 25 listings

  • Visible for 60 days

  • One-time payment (non-renewable)

c. Professional Plan – $29.99/month

  • Up to 100 listings

  • Visible for 120 days

  • Auto-renews monthly unless cancelled

d. Additional Terms

  • Prices are in USD and may include taxes

  • Payment is processed via secure gateways

  • Fees are non-refundable regardless of listing usage

  • The Platform may update plan pricing or features with prior notice
